Obtaining Citizenship as a Victim of Domestic Violence

Immigration recognizes that suffering domestic violence at the hands of a loved one is a traumatic experience and has therefore passed amendments to protect spouses, ex-spouses, intended spouses, and children of U.S. citizens.

If you obtained lawful permanent residence status (“Green Card”) on the basis of having been battered or subjected to extreme cruelty by your U.S. citizen spouse or parent, you may become a U.S. citizen without being required to meet all the general naturalization requirements.

A person who was a spouse subjected to battering or extreme cruelty by their citizen spouse is exempt from the following naturalization requirements:

  • Living in marital union with the citizen spouse for at least three years at the time of filing the naturalization application; and
  • U.S. citizenship status of the applicant’s spouse from the time of filing until the time the applicant takes the Oath of Allegiance.
